DescriptionJob Title: Temporary Attorney – Supplemental Needs Trust (SNT) / GuardianshipLocation: Manhattan, New York City, New York (On-Site)We are seeking a highly motivated Temporary Attorney to join a Supplemental Needs Trust (SNT) / Guardianship Team in a fast-paced government legal environment. This is an excellent opportunity for an attorney with prior experience in SNT/Guardianship and related areas to support the team with case review, court preparation, and client counseling.Key Responsibilities:
  • Case Handling & Court Appearances: Manage SNT, Guardianship, and Real Property (Nursing Home) cases with a heavy caseload, including frequent court appearances.
  • Litigation & Trust Management: Litigate issues surrounding trust disbursements, fiduciary duties, illusory trusts, and Medicaid recoveries.
  • Trust Removal & Surcharge: Pursue the removal and surcharge of trustees or guardians when necessary to protect the Agency’s interests.
  • Drafting & Counseling: Review and approve draft SNTs, counsel related programs, and ensure that executed SNTs comply with eligibility programs. Draft memos and correspond with outside counsel as needed.
  • Real Property Liens: Review and negotiate the removal of Real Property/Nursing Home Liens (RP Liens) upon sale or death of Medicaid recipients.
Qualifications:
  • NYS Bar Admission (Required)
  • 1-2 years of prior experience in SNT/Guardianship, trust disbursement, or related practice areas (Preferred)
  • Strong litigation experience, including court appearances, document drafting, and case management
  • Ability to communicate effectively with internal teams and external parties, providing clear and concise legal advice
  • Detail-oriented with a strong ability to handle complex cases
